Descartes se dedica a la ciencia con un fin práctico y no teórico, lo que permite verlo como un filósofo de la moral antes que como filósofo especulativo o de la ciencia. Su filosofía moral es una sola; pero siendo su moral perfectible, la expresa en el Discurso del método como pertrecho o aprovisionamiento del que viaja por la vida. En el Tratado de las pasiones, cuando se ha conquistado la conciencia de la libertad y es firme la resolución de (...) usarla siempre y nunca perderla, toma la forma de moral de la generosidad y no ya de aprovisionamiento. La distinción que introduce entre “certeza moral” y “certeza más que moral” se refiere a la garantía de la verdad y no a verdades tenues y firmes para emplear en lo práctico y en lo teórico respectivamente. The first contribution of this article is a politico-philosophical map that, drawing upon two common sets of arguments against modern natural rights, might help to explain the prevailing neo-republican position on natural rights. Under the label ‘abstraction argument’, we explore the view that natural rights are a metaphysical construct that usually ends in a violent application of speculative principles to society. Under ‘self-interest argument’, we discuss the notion that natural rights endorse an atomistic and selfish conception of the human being. (...) Second, we show how Cold War authors replicated these two arguments, conveying a biased, largely anti-republican and anti-democratic view of natural rights to the twentieth century. Third, drawing on these two arguments, we critically assess the narrow view of natural rights inherited by neo-republican scholars. (shrink)

El presente estudio se realizó con el objetivo de evaluar el impacto del estrés emocional en la adecuada toma de decisiones y práctica médica oportuna y de calidad de los estudiantes que cursan el quinto año de la carrera en la Facultad de Medicina de la Universidad Nacional Autónoma de México. Se utilizó una lista de valoración para las competencias de la simulación de reanimación cardiopulmonar avanzada, y un Cuestionario de Maslach Burnout Inventory para valorar los sentimientos, actitudes y de (...) desgaste profesional. Los resultados muestran que aquellos que estaban expuestos a mayor cantidad de labores recientes y estrés fueron más propensos de incidir en errores médicos durante la toma de decisiones y su aprendizaje. This study was conducted with the aim of assessing the impact of emotional stress in the appropriate decision-making and quality medical practice of fifth year medical students from the Faculty of Medicine of the National Autonomous University of Mexico. It was used an assessment list for cardiopulmonary resuscitation simulation competence and a Maslach Burnout Inventory Questionnaire was used to assess feelings, attitudes and professional wear and tear. Results show those who were exposed to a greater number of recent tasks and to greater stress were more likely to make medical mistakes while making decisions and learning. (shrink)

En este artículo se analizan, desde la antropología social, representaciones del orden social manifestadas por el fenómeno de las mandas y exvotos en el culto a santo Domingo Vidal, santo popular patrono del municipio de Chimá (Colombia). La metodología incluyó la observación participante en el sitio del culto y la descripción del Libro de mandas en el que escriben los devotos; los escritos son vistos como textos que transmiten y reproducen formas de cultura y de organización social. Para el análisis (...) se acude a los conceptos de Religión como sistema cultural y de Religión común para enfatizar su carácter adaptativo a las circunstancias locales. Las primeras conclusiones sugieren que la relación de los devotos con el santo responde a las condiciones sociales particulares de la comunidad en la que ocurre el culto y que esas prácticas las reproducen y mantienen. The goal of this paper is to argue that the Neptuno Alegórico and the Theatro de Virtudes Políticas, which were composed in 1680 by the Novohispanic philosophers Sor Juana Inés de la Cruz and Carlos de Sigüenza y Góngora to accompany respectively two arches erected to celebrate the entry of the Spanish viceroy to Mexico City, are notable not only as examples of panegyrical Baroque literature but also as philosophical texts aimed at moral instruction. To be specific, I argue that (...) the Neptuno and the Theatro belong to a hybrid genre that I label ekphrastic moral mirrors. Ekphrastic moral mirrors, which constitute a subset of the traditional speculum principis, are characterized by offering moral instruction to a prince indirectly, by means of an elaborate ekphrasis of a work of art (which, in the case of the Neptuno and the Theatro, were the two arches that they were paired with). I also argue that, insofar as the Neptuno and the Theatro create different audiences that are mutually aware of each other in virtue of systematically relying on ekphrasis deployed in a public setting, they are potentially more effective for moral instruction than other traditional mirrors of princes. La noción de ironía aparece en la Filosofía del derecho de Hegel como una figura del “mal moral” hacia el final de la segunda parte dedicada a la moralidad, junto con otras nociones como la hipocresía, la mala conciencia, el relativismo, etc. Si bien es cierto la crítica hegeliana a la ironía guarda una relación directa con la crítica al romanticismo de Schlegel en sus Lecciones de estética y con la figura del espíritu del “alma bella” en la Fenomenología del (...) espíritu, en la Filosofía del derecho Hegel aborda la dimensión moral de dicha expresión radical de subjetividad que requerirá ser superada desde el punto de vista de la eticidad. This paper takes on several distinct but related tasks. First, I present and discuss what I will call the “Ignorance Thesis,” which states that whenever an agent acts from ignorance, whether factual or moral, she is culpable for the act only if she is culpable for the ignorance from which she acts. Second, I offer a counterexample to the Ignorance Thesis, an example that applies most directly to the part I call the “Moral Ignorance Thesis.” Third, I argue for a (...) principle—Don’t Know, Don’t Kill—that supports the view that the purported counterexample actually is a counterexample. Finally, I suggest that my arguments in this direction can supply a novel sort of argument against many instances of killing and eating certain sorts of animals. (shrink)

This book presents a conceptual mapping of supererogation in the analytic moral philosophical tradition. It first asks whether supererogation can be conceptualised in the absence of obligation or duty and then makes the case that it can be. It does so by enlisting the resources of the continental tradition, specifically using the work of Emmanuel Levinas and his notion of infinite responsibility. In so doing the book contributes to the ongoing efforts to create a common ethical terminology between the analytic (...) and continental traditions within moral philosophy. Supererogatory actions are praiseworthy actions that go ‘beyond duty’, and yet are not blameworthy when not performed. In responding to this paradox, moral philosophy either brackets or attempts a reductionism of supererogation. Supererogation is epitomised in the paradigmatic figures of the saint and hero. Yet, most would agree that emulating these figures is too morally demanding. We rightly ask: where does moral obligation end? Is it even possible, or desirable to demarcate such a boundary? Besides the important theoretical issues these questions raise, they also speak to practical ethical dilemmas in the contemporary milieu, as they concern the global wealthy’s responsibility to the poor and the challenges of development aid work. This study sets out the main points in Leonardo Polo’s theory of moral development, which systematically articulates goods, norms, and virtues. To make them easier to understand, each point has been compared with Kohlberg’s theory of moral development, which is well known to specialists and radically different to it. We have chosen three aspects of Kohlberg’s theory of moral development to highlight the uniqueness of Polo’s theory: a) Kohlberg does not account for the specificity of voluntary acts, particularly the act (...) of deciding; b) The options that solve Kohlberg’s dilemmas are isolated from potential prior and subsequent decisions, so his moral development ignores any internal biographical storyline to the decisions themselves; and c) The Kohlbergian morality is an ethics of justice and duty, thereby relegating the friendship, which to Polo is the culmination of ethics, to a morally irrelevant level. Este artigo tem por objetivo examinar uma tensão existente no interior da teoria kantiana do respeito pela lei moral. Originalmente, na Fundamentação, o respeito é concebido por Kant como um mero efeito ou subproduto da imediata determinação da vontade pela lei moral. Na segunda Crítica, contudo, Kant parece conceder um papel mais positivo ao respeito, dando a ele a tarefa de enfraquecer a influência exercida pelas inclinações, o que contaria como uma promoção da influência da lei moral sobre a vontade. (...) Buscaremos mostrar que essa alteração na teoria kantiana do respeito é inteiramente devida a uma concessão a um difundido modelo de determinação da vontade que é de inspiração humiana. Além disso, buscaremos mostrar que esse modelo humiano tem de ser completamente abandonado, porque ele se choca tanto com a concepção refletida de Kant sobre motivação moral quanto com sua concepção refletida sobre a determinação da vontade pelas inclinações. RESUMEN Introducción: El mundo enfrenta un acelerado envejecimiento poblacional y tasas de fecundidad por debajo de los niveles de reemplazo, situación a la que no son ajenos la población y el servicio de Salud cubanos. Objetivo: Valorar las implicaciones sociales de los resultados del Servicio Provincial de Reproducción Asistida de Baja Complejidad de Camagüey, durante el bienio 2016-2017, dados en el incremento del número de embarazos logrados por Estimulación Ovárica Controlada e Inseminación Intrauterina. Métodos: En la contribución se emplearon los (...) métodos investigativos pertinentes, así como procedimientos diagnósticos y terapéuticos. Resultados: En el período estudiado, se logró un número significativo de embarazos por técnicas de baja complejidad, así como un número superior de embarazo en mujeres mayores de 36 años con respecto a años anteriores. Discusión: El Estado cubano ha trazado estrategias de trabajo para brindar atención diferenciada a las parejas que presenten alteraciones de la reproducción, en favor de solucionar la problemática mediante alternativas cuyos resultados se correlacionan con los obtenidos a nivel mundial. ABSTRACT Introduction: The world faces an intensive population aging and valuations of fecundity below the levels of substitution, situation which is not foreign to the Cuban population and health service. Objective: To value the social implications of the results of the Provincial Service of Assisted Reproduction of Low Complexity of Camagüey, during the two-year period 2016-2017, given for the increase of the number of pregnancies achieved by Controlled Ovarian Stimulation and Intrauterine Insemination. Methods: In the contribution thepertinent,investigative methods were used as well as diagnostic and therapeutic procedures. Results: In the studied period, a significant number of pregnancies was achieved by skills of low complexity, as well as a top number of pregnancy in women older than 36 years old with regard to previous years. Discussion: The Cuban State has planned work strategies to offer attention differentiated to the couples that present alterations of the reproduction, in favor of solving the problems by means of alternatives which results are correlated by the obtained ones on a global scale. According to the orthodox or humanist conception of human rights, individuals have a moral duty to promote the universal realization of human rights. However, advocates of this account express the implications of this duty in extremely vague terms. What does it mean when we say that we must promote human rights satisfaction? Does it mean that we must devote a considerable amount of our time and resources to this task? Does it mean, instead, that we must make occasional donations to (...) charities working to advance human rights realization? In this essay, I argue that this duty can only be constructed as imperfect. This means that it confers agent-relative discretion on us to decide when, how, and to what extent to advance the human rights of others. It also means that it is neither correlative with rights nor enforceable. As I will explain, the main reason for this is that any attempt to construct it as a perfect duty would infringe the dignity of the potential duty bearers and thereby undermine the very values that human rights practice aspires to serve. Finally, I will conclude by providing some guidelines for those who wish to comply with their imperfect duties to improve the situation of those whose human rights are in peril. (shrink)

This paper intends to examine a tension within Kant's theory of respect for the moral law. Originally, in the Groundwork, respect is conceived by Kant as a mere effect or by-product of the immediate determination of the will by the moral law. However, in the Second Critique, Kant seems to confer to respect a more positive role by assigning to it the task to weaken the influence exercised by the inclinations, thereby promoting the influence of the moral law on the (...) will. We show that this shift in Kant's theory of respect is entirely due to a concession to a widespread model of determination of the will by inclinations, which is of Humean inspiration. Besides, we show that that Humean model must be completely abandoned because it is at odds both with Kant's considered view of moral motivation and of the determination of the will by inclinations.Este artigo tem por objetivo examinar uma tensão existente no interior da teoria kantiana do respeito pela lei moral. Originalmente, na Fundamentação, o respeito é concebido por Kant como um mero efeito ou subproduto da imediata determinação da vontade pela lei moral. Hutcheson es el teórico del sentido moral. y por tal se entiende una concepción de nuestro comportamiento ético y político que, a la par que sienta las bases de 10 que se ha instituido como concepción liberal de la política, es incapaz de considerar nuestro laborar en el mundo sin referirlo directamente a las imágenes comunitarias de 10 que sea el bien. Lo que Hutcheson nos puede enseñar es que nuestras discusienes actuales en filosofía política malentienden nuestra tradición y son (...) incapaces de leerla al completo: precisamente a poco que se mire en nuestro pasado se comprenderá que nunca han caminado por separado las concepciones entre un estricto y autónomo sentido moral que juzga desde sí y una benevolencia comunitaria que le da los significados con los que juzgar. The essays collected here have been written in honor of Francesca Menegoni, professor of moral philosophy at the University of Padua and internationally renowned scholar of German classical philosophy. Beyond the plurality of the themes they deal with, what they have in common is the conviction that the systematic analysis of the problematic nodes that go through German classical philosophy allows us to take up the fundamental challenges of our contemporaneity.

Uberrima Fides is a legal doctrine that governs insurance contracts and expects all parties to the insurance agreement to act in good faith by declaring all material facts relative to a policy. The doctrine originated in England in 1766 with the case Carter v Boehm ruled by Lord Mansfield. Ever since, it has become, with some differences in interpretation, a cornerstone of insurance relationships around the world. The role that trust plays within it, however, is not simple and should not (...) be taken for granted. While it is expected that an idea of trust represents an order of truth, trust in itself is the outcome of a complex negotiation of moral orders. Semiotically, trust operates here not as a Kantian category for the understanding but as a signifier of an order of truth that upholds the possibility for insurance relationships. Trust, as sign, operates as a condition of possibility for the performance of insurance. In this article, a Foucaultian approach is employed to problematise the idea of trust and its role in insurance relationships. The case of mis-selling of insurance policies in the United Kingdom since the 1980s, which has given rise to numerous legal rulings, is used as the empirical site for the problematisation. (shrink)

En este trabajo pretendo mostrar el modo como la simpatía humeana sirve para convertir las pasiones barrocas en sentimientos morales con los que el interés puede establecerse como algo admisible en un comportamiento virtuoso. Ello supone la admisión de que no hay moralidad sino en un contexto social desde el cual se afinan los sentimientos de un modo reflexivo, aunque no únicamente racional siguiendo el mismo modelo que se usa para afinar el sentido del gusto.

Entre los intérpretes que problematizan la cuestión del sujeto moral en el pensamiento de David Hume, Pauline Chazan ha defendido la existencia de ciertas tensiones entre el sujeto de carácter pasional que Hume tematiza en el libro 2 del Tratado de la Naturaleza Humana y el posterior ingreso de dicho sujeto al campo de la moralidad, elaborado en el libro 3. Este trabajo ofrece una lectura novedosa de la teoría humeana de la subjetividad que permite reconsiderar y resolver este supuesto (...) conflicto entre el sujeto pasional y el sujeto moral. Para ello, desarrolla una concepción multidimensional de la subjetividad que permite concebir la formación del sujeto como un proceso complejo y gradual que involucra simultáneamente varios niveles distintos que, aunque puedan estudiarse de forma independiente, se encuentran estrechamente vinculados. Among the commentators who problematize the issue of the moral self in David Hume's thought, Pauline Chazan has argued for the existence of some tensions between the passionate self that Hume thematizes in Book 2 of A Treatise of Human Nature and how this self subsequently gets in the moral domain, which Hume elaborated in Book 3. This paper offers an innovative reading of Hume's theory of subjectivity, which allows reconsidering and resolving this apparent conflict between the passionate self and the moral self. To do so, it develops a multidimensional conception of the subjectivity allowing to conceive the formation of the self as a complex and gradual process involving simultaneously different levels that, even though may be studied separately, are closely connected. The aim of this paper is to critically examine Rawls’ discussions of the method of a moral theory spread through his book A Theory of Justice. First, Kant’s reasons for rejecting the attempt to employ in philosophy a method inspired in mathematics, respectively, in geometry are considered. This provides a basis for rejecting the interpretation given by Maria Carolina and Zeljko Loparic, according to which Rawls would have allegedly followed Kant’s indications, and applied methodological developments of the Greek geometry to (...) the solution of philosophical problems. Second, a brief analysis of some passages in Rawls’ book is given from which it becomes clear that despite his references to several methodological guidelines his real inspiration comes from Chomsky’s linguistics. The aims and method of Chomsky’s linguistics is then discussed to show the parallelism between them and Rawls’ own statements on the aims and method of his moral theory. Finally, it is argued that the purported parallelism collapses because, among other things, the data of a philosophical moral theory are completely different in nature from the data in linguistics. Pedro Sanchez de Acre, born at the beginning of the 16th century, was a prebendary of the cathedral of Toledo. He wrote three books about moral philosophy: Tree of Consultation and Varied Teaching in 1584, Moral and Philosophical Histor y in 1590 and Triangle of the Three Theological Virtues in 1595. These three books, representative of Miscellany, one of the most editorially successful literary genres of the 16th century, have become completely unknown with the passing of time. Besides the rare (...) quotation, used mostly in writings of a bibliographic nature, the presence of these books in Spanish philosophy is almost nonexistent. (shrink)

In this essay are sketched out the philosophical features of the 98's generation, which is characterized by a tragical tension between radicalism, utopia, and nichilism. Altought it has not elaborated a Philosophy in a proper sense but only a kind of reflection in form of ensayo or novel, typical manifestation of an age of crisis, it expresses primarilly and essentially an ontological and existential pessimism, which has a relevance not only for Spain but also for Europe, facing the typical dilemma (...) between positivistic scientism and moral ideals. Transparency has evolved from an individual, dangerous power in Plato to a desirable, collective property in the contemporary world. This paper intends to give a brief account of this long and somehow surprising path and extract some interesting consequences for economic and political activities, as well as for information technologies. Six literary masterpieces are used to highlight the contradictions and dangers entailed by the abuse of the fascinating metaphor of transparency. In the end, what is usually intended when demanding transparency (...) from a corporation, a firm or a state is more (or more accessible) information about it, i.e., understandable and abundant black and white data. This means reporting, picturing, producing material, becoming apparent, which is precisely the contrary of being transparent. We don’t want to look through , but to look directly at . The question, then, is not transparency, but opacity: what do we need and want to see, and how is this going to be produced? (shrink)

In most common-law and civil-law jurisdictions, mistakes of law do not excuse. That is, the fact that one was ignorant of the content or requirements of some law does not excuse violations of that law. Many have argued that this doctrine is mistaken. In particular, many have argued that if an individual’s ignorance or false belief is blameless, if she held the false belief reasonably, then she ought to be able to use that ignorance as an excuse for violating the (...) law. It is much harder to find defenders of the doctrine, despite its prevalence. Pragmatic considerations are occasionally offered on its behalf, but these are generally not impressive. In this paper, I consider a more direct kind of justification for the doctrine, one that attempts to identify something more immediately normatively objectionable about being ignorant of the law. In particular, I consider an argument that suggests that legal ignorance is more like moral ignorance than like nonmoral ignorance and maintains that even nonculpable moral ignorance does not excuse. La llamada "moral civil" tiene tres características principales: es una "ética de mínimos", es plenamente racional, y se establece por consenso. Sin embargo, la ética no se mide por el número de preceptos, y los sistemas éticos no pueden ser clasificados por un criterio de cantidad. Más aun, es un punto de partida falso considerarla como un pensamiento racional uniforme frente a una pluralidad de creencias religiosas. Y si el consenso es sólo el resultado de una votación, puede fácilmente convertirse (...) en una dictadura de la mayoría.
